Misdemeanors under Florida law include any offense for which the maximum punishment is one year in the County Jail. They include offenses such as Possession (less that 20 grams) of Marijuana, Assault, Battery, Retail Theft and DUI. Misdemeanors are handled in County Court and, if convicted, sentencing for these charges is within the discretion of the County Court Judge.

Exceptions to this rule occur most often in cases involving multiple DUI convictions and certain other traffic offenses where the Florida Legislature has enacted mandatory sentencing provisions which must be imposed by the Court. Therefore it is critical to vigorously defend these cases, through trial if necessary, to protect your family, employment and freedom.
